Volt Cycle Rental Agreement / Waiver

I hereby agree to the agreement contained herein.

I understand that my credit card will be charged a $250 security deposit that will be released to my card upon satisfactory return of the bike.

I hereby authorize VOLT CYCLE to charge my credit card on file for total rental.

You can cancel any reservation within 24 hrs for free. Cancellation after 24 hrs 15% will be charged to your card.

If the rental is not returned within 15 minutes of your drop-off time you will be charged an additional 2-hour rate of

$39 per 2-hour block.

If the bike is not returned within 48 hours after the end of the rental agreement period, I understand the card on file will be charged full retail value for the bike rental.

I, the customer will be responsible for any and all damages to the bike and equipment, including mechanical and
electrical. Not including normal wear and tear.

By signing this agreement, I acknowledge that there are known and unanticipated risks that could result in physical and
emotional injury, paralysis, death, damage to myself (or my child), to property, and to others.

The risk includes, but are not limited to, collision with stationary or movable objects; injury or accident involving contact with the bike; falls; negligence of other riders, myself (or my child) or other persons that may be present; musculoskeletal injuries including head, neck, and back injuries; exhaustion; equipment failure; my own physical condition and the physical exertion associate with this activity.

Furthermore, Volt Cycle personnel have difficult jobs to perform. They seek safety but are not infallible. They may be unaware of a participant’s fitness or abilities. They may misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction.

I expressly agree and promise to accept and assume all of the risks existing in this activity. My (or my child) participation in the activity is completely voluntary, and I elect to participate in this activity in spite of the risks. I agree to wear a properly fitted and secured DOT or SNELL-certificate helmet while participating in this activity.

I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Volt Cycle from any and all claims, demands, or causes of action, which are anyway connected to with my participation in this activity in this activity or my use of Volt Cycle’s equipment or facilities, including any such claims which allege negligent acts or omissions from Volt Cycle.

Should Volt Cycle or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement. I agree to indemnify and hold them harmless for all such fees and costs.

I certify that I have adequate insurance to cover any injury or damage I (or my child) may cause or suffer while participating, or else I agree to bear the cost of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I (or my child) may have.

Even If file a lawsuit against Volt Cycle, I agree to do so solely in the State of California, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict or law rules of that state. I agree that if any portion of the agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.

By signing this document, I acknowledge that if anyone is hurt if the property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against Volt Cycle on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at Volt Cycle. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.
